And with each new wave, come new concerns such as privacy and third party liability issues, online testimonials, to say nothing of ethical and legal questions.  And more, what will affect the success of behavioral advertising?  Well, indeed at the end of 2007, the FTC proposed online behavioral advertising policy principles to address consumer privacy concerns. For instance, one of the proposals calls any company that collects or stores consumer data for behavioral advertising should provide reasonable security for that data and should retain data only as along as is necessary to fulfill a legitimate business or law enforcement need.  What does that mean exactly?  Or what if you collect sensitive data for behavioral advertising, how would you obtain affirmative, express consent from the consumer to receive such advertising?  ERA wants its members and the industry at-large to understand these and a number of other related legal issues.</description>
